Default Lima, Peru Interview and general fiancee visa questions

Hi,

I have been told the following by a high priced Fiancee Visa attorney from the East Coast.

If you have a girl from Lima, Peru......that embassy is one of the most problematic in the world. The Consul General, as well as the one before, are hostile to fiancee visa petitioners (the fiancee) and will most likely deny without aggressive support of an attorney.

I have heard this before, but am not sure if its valid or not. Anyone have a fact or opinion on this?

Also.......in 1997, I successfully petitioned a girl from Russia to come here on a fiancee visa. She stayed for a few weeks then returned as the relatinship did not work out. I have not petitioned anyone since.

This lawyer states that I MUST prove that she returned or the case will be kicked back from Lima to UCSIS and make a six month delay while they investigate whether she returned or not. Who in the hell knows where she could be now, for Gods sake. I dont see anyway to prove 10 years later if someone returned or find them in Russia. I didnt keep airline receipts for 10 years.

Does anyone think I will have to prove this, or is he blowing smoke up my ass?

Thanks

Mikey

You've got a problem that only Gary or someone like him can answer.
My wife's K-1 took about three months more than I thought it should but when I appeared with my fiancee in the Lima embassy and having all of the proper documentaion, they allowed her fly the next day.
I have heard that the Lima embassy is very similar to Bogota.

Did you notify the Service in writing when your fiancee went home the last time?

No, I didnt send a letter. When I informed my East Coast, hot shot lawyer that she was going to return he said, "sorry to hear that" and told me to call him if I needed him in the future for another one. Didnt say anything about needing to document it. I figured I was paying him so if I needed anything he would tell me. All I remember him emailing later was that this "setback" in my life will not prohibit me from attempting another visa in the future. For the foolish amount of money I paid him, I guess the least he could have done is tell me to do that. I think I even held on to her flight info for awhile, but then ****canned it. I guess it boils down to being my fault.

One last question.......if the girl has a tourist visa and has visited the USA before and always returned home with no violations.......would her fiancee visa petition go smoother here and in Lima? You would think so, but nowadays who knows.

Ok........later

Mikey

No difference in whether she was here before or not as a criteria for the fiancee visa or the time that it will take. However, if she had been an overstay on prior visits, that issue would be raised.

I think Guangzhou and Manila are tougher than Lima. I have had 3 waiver of meeting cases down there and two of them slid right through. THe third got through after a lot of work but then, it was his third attempt at an alien spouse.
