This is a rather embarrassing question but one that needs to be asked. I recently filed bankruptcy. Not to go into the gory details, but my business went under and I had no choice. Although I filed a short time ago, it's not like I'm flat broke plus I have a lucrative job. Will this matter make it difficult or impossible for me to arrange a fiance visa if the need arises?

Hi Jook,

No need to be embarrased, these things happen and sometimes for the better, we just don't know it at the time it is happening. I don't know how this will pan out exactly and where it will hurt you, but I am thinking it will have some sort of a negative effect in one way or another. I do not know much about the affidavit of support except that you need minimum income requirements. Did you look at any of the visa web sites under that for leads to more info, you might find something therein.

I hate the avatar!

I did look at the regs and can't seem to find anything specific. I went through the fiance visa before (10+ years ago) and the info that is required is voluminous. My guess is that there's no written rule eliminating somoneone who's filed but it's a judgment call. If that's the case, I wouldn't find out until I filed it.

Bankruptcy has no impact on the Affidavit of Support (I-864) which is what the USCIS uses to determine if you can afford to sponsor an immigrant (i.e. your foreign fiancee/wife).

You said you "did look at the regs and can't seem to find anything specific". The reason you couldn't find anything is because its not addressed, because there is no impact.

What they care about is the last 3 years of income. The applicant (US Citizen and/or sponsor) must be able to show income at or above 125% of the USA poverty level. Check out the USCIS website and/or visajourney.com for the 125% income guidelines.

I've got a bunch of avatars that I recently made off the Mike in Brazil website [ripped the site, BTW] Anyone want these? If I get enough requests, I will post all of them for anybody to pick from...or I can email them to Ray/Tonk and they can DL them into the hosting server. LMK. [img]smile.gif[/img]

What the hell does this has anything to do with visa's is beyond me...
